Please read these terms carefully. By accepting a quotation from Lee’s Garden Services, you agree to the terms applicable to the work being carried out.

Nothing in these Terms & Conditions affects your statutory rights as a consumer.

Lee’s Garden Services provides professional gardening, garden maintenance, lawn care, hedge cutting, pruning, grounds maintenance and related outdoor services.

We are based in Penkridge, Staffordshire and provide services to domestic and commercial customers within our service area.

Services provided by Lee’s Garden Services may include:

The exact work to be undertaken will be discussed with you and, where appropriate, detailed in the quotation we provide.

Quotations & How We Work

Our usual quotation process is straightforward.

When you contact Lee’s Garden Services about work you would like carried out, we will normally arrange a convenient time to visit your property.

During the visit, we will inspect the garden or outdoor area, discuss the work you require and assess what is involved.

We will then prepare and send you a free, no-obligation quotation.

You are under no obligation to accept our quotation.

If you would like us to carry out the work, you can accept the quotation, and we will arrange a suitable date or schedule for the work to be completed.

Accepting a Quotation

A quotation is based on the work discussed and the conditions reasonably visible when we inspect your property.

When you accept our quotation, you are agreeing for Lee’s Garden Services to carry out the work described in the quotation at the agreed price, subject to these Terms & Conditions.

Please check your quotation carefully before accepting it and let us know if anything is incorrect or if you would like the proposed work changed.

If the scope of the work changes after the quotation has been accepted, we will discuss this with you before carrying out significant additional work.

Additional & Unforeseen Work

Occasionally, circumstances may only become apparent once work has started.

If we discover additional work that could not reasonably have been identified during our initial visit, we will discuss this with you before proceeding wherever reasonably practical.

If you ask us to carry out additional work that was not included in the original quotation, an additional charge may apply.

Any additional costs will be discussed and agreed with you before the additional work is undertaken.

Arranging the Work

Once you have accepted your quotation, we will arrange a suitable date for the work.

For regular garden or grounds maintenance, we will agree an appropriate schedule with you.

We will make reasonable efforts to attend on the agreed date or according to the agreed schedule.

Gardening and grounds maintenance work can, however, be affected by weather, ground conditions and other circumstances outside our reasonable control. Occasionally, work may therefore need to be rearranged.

Where reasonably possible, we will contact you if an appointment needs to be changed and arrange another suitable date.

Access to Your Property

You are responsible for ensuring that we have safe and reasonable access to the areas of your property where the agreed work is to be carried out.

This includes ensuring that gates, driveways, paths and other necessary access points are available where appropriate.

If you will not be at the property when we attend, any necessary access arrangements should be agreed with us beforehand.

If we cannot gain access to the property at the agreed time, we may need to rearrange the work.

Please let us know in advance about anything that could restrict or affect access.

Customer Responsibilities

Before work begins, you should tell us about anything that could affect the work or create a potential hazard.

This may include:

  • Underground cables or pipes
  • Irrigation systems
  • Outdoor electrical cables
  • Hidden structures or objects
  • Drainage systems
  • Ponds and water features
  • Fragile garden ornaments
  • Pets
  • Access restrictions
  • Known hazards within the garden
  • Areas or plants that should not be disturbed

You should remove or identify fragile, valuable or easily damaged items from the working area before we begin.

We cannot reasonably be expected to identify underground, concealed or otherwise hidden items unless you have informed us about them.

Plants, Trees, Hedges & Lawns

Gardens contain living plants whose condition and future growth can be affected by many factors outside our reasonable control.

These can include:

  • Weather
  • Temperature
  • Soil conditions
  • Drainage
  • Watering
  • Disease
  • Pests
  • Previous maintenance
  • Wildlife
  • Seasonal conditions
  • Customer aftercare

We will use reasonable care and skill when carrying out gardening work.

However, we cannot guarantee the future health, growth, appearance or survival of plants, trees, shrubs, hedges, lawns or newly laid turf where circumstances are outside our reasonable control.

Customers are responsible for following any reasonable aftercare instructions provided.

Hedge Cutting, Tree & Shrub Pruning

The appropriate timing and extent of hedge, tree and shrub cutting can depend on the species, condition, season and surrounding environment.

We reserve the right to recommend postponing, reducing or altering work where we believe carrying it out could be inappropriate, unsafe or potentially harmful to the plant.

Some trees, hedges or other vegetation may also be subject to legal restrictions or protections.

Where appropriate, it is the property owner’s responsibility to inform us about any known Tree Preservation Orders, conservation area restrictions or other restrictions affecting the proposed work.

Wildlife & Nesting Birds

Lee’s Garden Services aims to carry out gardening work responsibly and with appropriate consideration for wildlife.

Certain gardening activities, particularly hedge cutting and vegetation clearance, may need to be changed or postponed where protected wildlife is present.

If an active bird nest or other protected wildlife is discovered before or during work, we may stop, postpone or alter the affected work where necessary.

Where this happens, we will discuss the situation with you and explain what work can reasonably be completed.

Lawn Cutting

Regular lawn cutting will be carried out according to the schedule agreed with the customer.

Grass growth can vary considerably depending on the season, weather, lawn condition and any treatments being applied.

We may postpone lawn cutting where the ground is excessively wet, frozen or otherwise unsuitable and where mowing could cause unreasonable damage to the lawn or create unsafe working conditions.

Lawn Treatments

Any lawn treatment recommendations will be based on the condition of the lawn when it is assessed.

The effectiveness of lawn treatments can be influenced by factors outside our control, including:

  • Weather
  • Soil conditions
  • Drainage
  • Watering
  • Mowing
  • Pests
  • Disease
  • Lawn usage
  • Customer aftercare

For this reason, we cannot guarantee a particular result from every lawn treatment.

Where aftercare is required, customers should follow the advice provided.

Turfing & New Lawns

Good preparation and appropriate aftercare are important when new turf is laid.

Following installation, newly laid turf will normally require regular watering and appropriate care while it establishes.

Customers are responsible for following any watering and aftercare instructions provided.

We cannot accept responsibility for deterioration caused by circumstances outside our reasonable control, including inadequate watering, extreme weather, pets, excessive use, neglect or failure to follow reasonable aftercare advice.

Green Waste

The removal of grass cuttings, hedge trimmings, branches and other garden waste will depend on what has been agreed as part of your quotation or service.

Please do not assume that removal of all garden waste is included unless this has been agreed with us.

Where waste removal is included, we will handle and dispose of the waste appropriately.

Weather Conditions

Gardening and grounds maintenance work is particularly dependent on weather and ground conditions.

Heavy rain, high winds, extreme heat, frost, snow, storms, waterlogged ground or other unsuitable conditions may make certain work impractical, unsafe or potentially damaging to your garden.

We reserve the right to postpone, rearrange or stop work where we reasonably believe conditions make it unsafe or inappropriate to continue.

Where this happens, we will arrange another suitable date where reasonably possible.

Delays & Unforeseen Circumstances

We will make reasonable efforts to carry out work on the agreed date.

However, work may occasionally be delayed by circumstances outside our reasonable control.

These can include:

  • Adverse weather
  • Unsafe working conditions
  • Equipment failure
  • Illness
  • Access problems
  • Delays caused by previous work
  • Material or supply problems
  • Protected wildlife
  • Ground conditions
  • Other unforeseen circumstances

Where a significant delay occurs, we will make reasonable efforts to keep you informed and rearrange the work where necessary.

Regular Garden & Grounds Maintenance

Where we provide a regular garden or grounds maintenance service, the frequency of visits will be agreed with you.

The amount and type of work required may vary throughout the year because gardens grow and change according to the season and weather conditions.

Certain jobs may therefore be carried out seasonally rather than during every visit.

Where weather or other circumstances prevent a scheduled visit, we will make reasonable efforts to rearrange the work where appropriate.

Cancellation & Rearranging Work

If you have accepted a quotation but subsequently need to cancel or rearrange the work, please contact Lee’s Garden Services as soon as possible.

We understand that circumstances can change and will make reasonable efforts to accommodate requests to rearrange work.

Where materials have been specially ordered, or other costs have already been reasonably incurred specifically for your work, you may be responsible for those costs where permitted by law.

Depending on how and where a contract is agreed, consumers may have statutory cancellation rights.

Nothing in these Terms & Conditions removes or restricts any cancellation rights you may have under applicable UK consumer law.

Payment

Unless otherwise agreed, payment is due following completion of the agreed work.

Lee’s Garden Services currently accepts payment by:

  • Cash
  • Cheque
  • Bank transfer

Payment should be made for the amount agreed in your quotation together with the cost of any additional work subsequently agreed with you.

If different payment arrangements are required for a particular job, these will be discussed with you before the work is carried out.

For larger jobs or work requiring materials to be purchased in advance, we may request a deposit or payment towards materials before work begins. If this applies, it will be made clear to you before you agree to proceed.

Completion of Work

Lee’s Garden Services will carry out the agreed work with reasonable care and skill.

Once the work has been completed, if you believe there is a problem with the service provided, please let us know as soon as reasonably possible.

This allows us to inspect the issue and, where appropriate, discuss how it can be resolved.

Damage & Liability

We take reasonable care when working on your property.

If you believe we have caused damage through our negligence, please contact us as soon as reasonably possible so that we can investigate the matter.

We cannot accept responsibility for damage resulting from defects, hazards or items that were hidden, concealed or could not reasonably have been identified before work began.

We are not responsible for loss or damage resulting from circumstances outside our reasonable control.

Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Complaints

We want our customers to be satisfied with the services provided by Lee’s Garden Services.

If you have a concern or complaint about work we have carried out, please contact us as soon as reasonably possible.

Please explain the issue so that we have an opportunity to understand the problem, inspect the work where appropriate and discuss a reasonable solution.

Your Consumer Rights

If you are a consumer, you have legal rights in relation to services provided to you.

Nothing in these Terms & Conditions is intended to exclude, restrict or reduce your statutory rights.

Our services will be provided with reasonable care and skill as required by applicable UK consumer law.
